Port Lavaca Man Indicted on Child Pornography Charges

VICTORIA, TX—Roselio Garcia, 54, of Port Lavaca, Texas, has been indicted on 10 counts of child pornography, acting United States Attorney Tim Johnson announced today. The sealed indictment returned on March 25, 2009, was unsealed following Garcia’s arrest on March 27, 2009, by agents of the FBI.

The first count of the indictment charges Garcia with possession of child pornography, relating to his alleged possession of pornographic images found on a computer and hard drive. Counts two through seven charge Garcia with receiving six images of child pornography over the Internet using a file sharing program. Counts eight through 10 also charge Garcia with the distribution of three of the six images named in counts two through seven.

Garcia was arraigned today and ordered held in federal custody without bond pending trial. The case is set for trial on May 12, 2009, in Victoria, Texas.

This case was investigated by agents of the FBI and Corpus Christi Police Department and is being prosecuted by Assistant United States Attorney Carol Wheeler.

An indictment is a formal accusation of criminal conduct, not evidence. A defendant is presumed innocent unless convicted through due process of law.
